Pierre Bourdieu si è misurato a lungo con la definizione del “quadro concettuale” della “teoria della società”, a partire dalla riflessione sul rapporto non chiarito fra la “teoria dell’azione” e la “teoria strutturalista”, ossia dalla questione preliminare di come le due principali strategie concettuali attraverso cui si sono orientate le scienze sociali si possano integrare in un “modello unitario”. La “prospettiva relazionale” indaga la genesi, lo sviluppo e la crisi tanto delle strutture sociali quanto delle rappresentazioni, dei comportamenti (...) e dei vissuti soggettivi che si manifestano all’interno di tali strutture, focalizzando l’analisi sui sistemi di relazioni tra oggetti ed eventi piuttosto che sui singoli fenomeni. Bourdieu tenta di superare il tradizionale antagonismo tra la “fisica oggettivista” dello strutturalismo e il “soggettivismo costruttivista” della fenomenologia e della teoria dell’azione, mettendo in relazione la riproduzione-distribuzione delle risorse materiali (“oggettività di primo ordine”) e degli schemi mentali e corporei tramite cui sono interpretate, valutate e vissute le situazioni e si rinnova simbolicamente la società (“oggettività di secondo ordine”). Come vedremo, i concetti di capitale e di habitus a disposizione dei soggetti individuali e collettivi all’interno dello spazio sociale e dei campi specifici caratterizzano tale indagine. (shrink)

Nel presente articolo sono illustrati i concetti che distinguono la sociologia di Pierre Bourdieu – campo, capitale, habitus, interesse, azione – indicando il nesso tra la costruzione di definizioni astratte, più frequenti negli scritti degli anni ’70, e la pratica di ricerca da cui quei concetti derivano e in cui trovano applicazione. Il sociologo francese ha costruito, infatti, un sistema di concetti interconnessi con cui descrive le componenti e i processi di riproduzione fon-damentali del mondo sociale e indirizza (...) le ricerche empiriche su ambiti d’analisi particolari. D’altra parte, egli ha mostrato una resistenza a presentarlo criticando le operazioni “scolastiche” di sistematizzazione che, secondo il sociologo, “normalizzano” l’opera ai fini accademici dell’insegnamento e intellettuali della divulgazione facendo perdere la complessità del lavoro in cui i concetti sono impiegati. Egli ritiene, infatti, che non si possa comprendere l’opera – l’opus operatum – se non si restituisce al “fare” della ricerca sugli oggetti – modus operandi. (shrink)

This paper is basically a presentation of the tenets of Pierre Bourdieu’s philosophy in a language and level that can be easily understood by Filipino students and scholars of philosophy, cultural studies and Philippine studies. The discussion of Bourdieu’s philosophy revolves around 1) his concepts of habitus, field and symbolic violence; 2) his critique of television; 3) his theory of capitals; 4) some implications of his theory of capitals; and 5) his being public intellectual. The ultimate aim (...) of this paper is to suggest some aspects and dimensions of Philippine society and culture that can be analyzed using some of bourdieu’s thoughts as interpretive frameworks, as well as to challenge the said Filipino students and scholars of philosophy, cultural studies and Philippine studies to creatively and effectively appropriate such theories for the enrichment of the theoretical corpus of Philippine studies. Nel presente articolo esamino l’idea di una “sociologia riflessiva” – a lungo professata e auto-imposta da parte di Pierre Bourdieu – che tematizza il rapporto tra la teoria sociale e la prassi di vita al fine di riflettere sulle modalità pratiche della ricerca sociologica e di interpretare il ruolo svolto dai sociologi in quanto tali nella riproduzione dell’ordine sociale. Secondo Bourdieu, infatti, il controllo del rapporto tra il ricercatore e l’oggetto di indagine deve avvenire, al contempo, su (...) tre livelli di riflessione: sul piano delle condizioni epistemologiche e socio-culturali che rendono possibile la pretesa di scientificità della conoscenza sociologica, sul piano delle disposizioni pratiche che orientano il lavoro di ricerca di soggetti dotati di particolari habitus, e sul piano della loro collocazione specifica nel campo culturale e nello spazio sociale. We cannot simply observe that Emile Durkheim, Claude Lévi-Strauss, and Pierre Bourdieu all received philosophical training and subsequently asserted, in surprisingly similar terms, that escaping from philosophy or breaking away from philosophical modes of thought was a necessary condition for any research in the human and social sciences, without considering whether there might be a direct relationship between the sociological ethos and a particular attitude towards philosophy. The "rupture" with philosophyis never complete: the sociologists' conception of sociology is, (...) on the contrary, heavily influenced by the negative image they have of philosophy, which they always invoke as something to be avoided or a specter that must be exorcised. The sociological perception of philosophy thus constitutes a system of oppositions, a set of likes and dislikes deeply ingrained in the minds of practitioners in the human and social sciences, and which, so to speak, form the very foundation of the discipline and its definition of its identity. By reconstructing it, this article proposes a sociological analysis of the genesis, structure, and function of the sociological unconscious. (shrink)

When Pierre Bourdieu addresses the problem of why people from certain discriminated groups are hardly present in some fields, he emphasizes the role of stylistic factors that cannot be captured in terms of rules. An alternative explanation refers to split systems, both of which can be captured by means of rules.

Drawing on a close reading of Pierre Bourdieu’s works, I offer five lessons for a science of crime and punishment: always historicize; dissect symbolic categories; produce embodied accounts; avoid state thought; and embrace commitment. I offer illustrative examples and demonstrate the practical implications of Bourdieu’s ideas, and I apply the lessons to a critique of orthodox criminology.

This paper presents five responses to Toril Moi’s question of why study Pierre Bourdieu, dividing them into responses which suppose that Bourdieu’s originality is negligible and responses which do not.

Focused on the notion of the threshold of objectivity, my article dissects the empirical mirror-glass of the philosophy of Joseph Melançon. I propose to thrust this emblematic perspective of determinist discourse against the literary turn, acclaimed for its underpinning ambiguous subjectivity – here notably made relevant by Pierre Bourdieu. Both discursive practices complete each other and reject each other in a self-feeding spiral: incessant motivation for a hybrid, vexing study of mutual tensions.

The Concepts of Bourdieu's Distinction: A Social Critique of the Judgement of Taste -/- The way Bourdieu introduces foreign concepts (habitus, doxa, logic of practice) is through jumping straight and enthusiastically into his deep thoughts, instead of clearly and logically defining them first. -/- Accepting these dominant characteristics of taste is, according to Bourdieu, a form of \" symbolic violence .\" That is, the fact of considering these distinctions between tastes as natural, and believing that they are (...) necessary, denies the dominated classes the possibility of defining their own world, which puts those with less general capital at a disadvantage. Moreover, even when the dominated social classes come to have their own ideas about what it is \"good taste \"and what is not,\" the aesthetics of the working class is dominated aesthetic, which it is obliged to always defined in terms of the aesthetics of the ruling class . The main purpose of this paper is to explore Pierre Bourdieu’s conception of social science. To this end, the paper sheds light on the main epistemological presuppositions that undergird Bourdieu’s defence of reflexive sociology as a scientific endeavour. The predominant view in the literature is that, in most of his writings,Bourdieu has a tendency to embrace a positivist conception of social science. When examining Bourdieu’s conception of social science in more detail, however, it becomes clear (...) that the assumption that he remains trapped in a positivist paradigm does not do justice to the complexity of his multifaceted account of social science. In order to illustrate the complexity of Bourdieu’s conception of social science, the following analysis scrutinises ten epistemological tensions which can be found in Bourdieu’s writings on the nature of knowledge production. In view of these epistemological tensions, a more fine-grained picture emerges which demonstrates that Bourdieu invites,and indeed compels, us to reflect upon the complexity of the various tension-laden tasks posed by the pursuit of a critical social science. Bourdieu argues that political inclination is dependent upon one's position in the academic field, and not vice versa. Distinguishing between three hierarchically arranged fields of power, he places the academic field in a middling position between the political and social fields. He posits a hierarchy of the faculties, in which those at the top are closer to political power. Bourdieu supports his argument using empirical data gathered through publicly available sources, presented in tabular form. University professors, Bourdieu (...) argues, are subordinate in the field of power to managers of industry and business, but are nonetheless "holders of an institutionalized form of cultural capital," and therefore culturally dominant with respect to writers and artists (36). These academics, especially those at the top of the social hierarchy, present higher percentages of "indices of social integration and respectability" (36-37). This paper contains a brief pastiche of analytic philosopher Carrie Ichikawa Jenkins, responding to the sociological theories of Pierre Bourdieu.

This paper investigates Robert Brandom’s programme of logical expressivism and in the process attempts to clarify his use of the term practice, by means of a detailed comparison with the works of sociologist and anthropologist Pierre Bourdieu. It turns out that the two scholars have a number of concerns in common, including the means by which core practices can be amalgamated into more sophisticated ones, and the possibility of explicating practices without distorting them or generating incoherent codifications. We (...) find some congruences between the two approaches but also a number of divergences. In particular, Bourdieu deprecates the well-known distinctions between langue and parole (Saussure), and competence and performance (Chomsky), while (we argue) Brandom ends up instituting his own “competence” model. We conclude by questioning how far this is compatible with his avowed aim of developing an “analytic pragmatism”. (shrink)

The controversial French philosopher Jacques Derrida is associated with the claim that, in the West, speech has historically been prioritized over writing. In this paper, I present some obvious counterexamples, though I am an admirer. I also raise a challenge to the social theories of Pierre Bourdieu, though I fear they are not wrong. The paper is written as a pastiche of a notable fiction writer from the Indian subcontinent, but set in the West.

I suoi interessi di studio sono rivolti alle trasformazioni dello sviluppo tecnologico nell’ambito delle forme della conoscenza e della comunicazione e alle conseguenze economiche e politiche del nuovo cyberspazio sull’evoluzione antropologica e sociale. Pierre Levy esamina, quindi, i processi basilari del processo di globalizzazione su cui si concentrano le scienze (...) sociali; ma a suo modo, da intellettuale francese che «non aspira all’esattezza storica o scientifica, ma alla fecondità filosofica e pratica». L’intelligenza collettiva. Per un'antropologia del cyberspazio (1994) si presenta come un'opera suggestiva che contiene riflessioni lucide in un linguaggio personalizzato, con concessioni liriche imbarazzati e con una narrazione ridondante. Tuttavia, in questa opera così eterodossa, è possibile ritrovare un nucleo di analisi sociologica che affonda alcune delle sue premesse nella teoria dell’evoluzione dei sistemi sociali. Nella prima parte ,presento la teoria degli spazi antropologici , da una prospettiva diacronica: gli spazi antropologici – Terra, Territorio, Merci, Sapere – corrispondono a sviluppi evolutivi della specie umana - società primitive,antiche, moderne e contemporanee - in un processo discontinuo di significazione della riproduzione simbolica e materiale. Nell’analisi dello Spazio del sapere, si evidenzia come il consolidarsi del nuovo cyberspazio potrebbe ridefinire l’organizzazione e lo sviluppo degli spazi precedenti e si sottolineano le finalità pratiche della complessa prospettiva di Pierre Lévy (A): «una filosofia politica degna di questo nome non può accontentarsi di analizzare e sezionare una situazione senza assumersi il rischio di indicare una via di uscita adeguata». L’ambito dell’analisi diventa, infine, quello delle relazioni armoniche e cacofoniche tra i differenti spazi antropologici con la riuscita metafora dei quattro punti cardinali (B). (shrink)

This chapter will explore the reception of Condillac in Argentina from the nineteenth century to the early twentieth century, focusing on two cases. First, the reception by nineteenth-century professors of idéologie (Juan Crisóstomo Lafinur, Juan Manuel Fernández de Agüero, Luis José de la Peña, and Diego Alcorta) that was mediated by the interpretations of Antoine Destutt de Tracy, Pierre Jean Cabanis, and Pierre Laromiguière. Second, the reception in the early twentieth century by José Ingenieros, whose narrative was conditioned (...) by his own political and philosophical agenda. In each case, we can identify different receptions that must be interpreted not only in light of the philosophical concerns of the authors who made them but also in light of the wider cultural and political context in which they emerged. In the first half of the nineteenth century, Condillac was received as a philosopher who integrated the new philosophical canon that would replace the Scholastic canon that had been imposed by the colonial regime. In the early twentieth century, Ingenieros inserted Condillac into a narrative that, starting with Bacon and Locke, culminated in positivism, a current that, in his view, offered the best framework to make Argentina shine in the concert of civilized nations. An English translation of Pierre Bayle's posthumous last book, Entretiens de Maxime et de Themiste (1707), in which Bayle defends his skeptical position on the problem of the evil. This book is often cited and attacked by G.W. Leibniz in his Theodicy (1710). Over one hundred pages of original philosophical and historical material introduce the translation, providing it with context and establishing the work's importance.

Is calculation possible without language? Or is the human ability for arithmetic dependent on the language faculty? To clarify the relation between language and arithmetic, we studied numerical cognition in speakers of Mundurukú, an Amazonian language with a very small lexicon of number words. Although the Mundurukú lack words for numbers beyond 5, they are able to compare and add large approximate numbers that are far beyond their naming range. However, they fail in exact arithmetic with numbers larger than 4 (...) or 5. Our results imply a distinction between a nonverbal system of number approximation and a language-based counting system for exact number and arithmetic. (shrink)

We propose a modular ontology of the dynamic features of reality. This amounts, on the one hand, to a purely spatial ontology supporting snapshot views of the world at successive instants of time and, on the other hand, to a purely spatiotemporal ontology of change and process. We argue that dynamic spatial ontology must combine these two distinct types of inventory of the entities and relationships in reality, and we provide characterizations of spatiotemporal reasoning in the light of the interconnections (...) between them. This paper demonstrates the innovative character of the approach to metaethics underlying John Dewey’s pragmatism. Dewey's theory of evaluation is contrasted with one of the most dominant contemporary metaethical theses: constructivism. I show that the insistence placed by metaethical constructivists on the actor’s practical point of view, on the rejection of the subjective preferences model, and on a specific form of ethical antirealism and naturalism echoes some of the most crucial claims made by Dewey. This argumentation leads to my main (...) hypothesis: an analysis of Dewey's conception of evaluation allows us to highlight the groundbreaking character of its metaethical approach—an approach that will be characterized as fairly constructivist. A presentation and discussion of Gottlob Frege's understanding of language, both natural and artificial, with close attention to his texts.

The mapping of numbers onto space is fundamental to measurement and to mathematics. Is this mapping a cultural invention or a universal intuition shared by all humans regardless of culture and education? We probed number-space mappings in the Mundurucu, an Amazonian indigene group with a reduced numerical lexicon and little or no formal education. At all ages, the Mundurucu mapped symbolic and nonsymbolic numbers onto a logarithmic scale, whereas Western adults used linear mapping with small or symbolic numbers and logarithmic (...) mapping when numbers were presented nonsymbolically under conditions that discouraged counting. This indicates that the mapping of numbers onto space is a universal intuition and that this initial intuition of number is logarithmic. The concept of a linear number line appears to be a cultural invention that fails to develop in the absence of formal education. (shrink)

The aim of this paper is to assess the relevance of somatic evolution by natural selection to our understanding of cancer development. I do so in two steps. In the first part of the paper, I ask to what extent cancer cells meet the formal requirements for evolution by natural selection, relying on Godfrey-Smith’s (2009) framework of Darwinian populations. I argue that although they meet the minimal requirements for natural selection, cancer cells are not paradigmatic Darwinian populations. In the second (...) part of the paper, I examine the most important examples of adaptation in cancer cells. I argue that they are not significant accumulations of evolutionary changes, and that as a consequence natural selection plays a lesser role in their explanation. Their explanation, I argue, is best sought in the previously existing wiring of the healthy cells. (shrink)

I propose a systematic survey of the various attitudes proponents of enaction (or enactivism) entertained or are entertaining towards representationalism and towards the use of the concept “mental representation” in cognitive science. For the sake of clarity, a set of distinctions between different varieties of representationalism and anti-representationalism are presented. I also recapitulate and discuss some anti-representationalist trends and strategies one can find the enactive literature, before focusing on some possible limitations of eliminativist versions of enactive anti-representationalism. Recent empirical and conceptual research has shown that moral considerations have an influence on the way we use the adverb 'intentionally'. Here we propose our own account of these phenomena, according to which they arise from the fact that the adverb 'intentionally' has three different meanings that are differently selected by contextual factors, including normative expectations. We argue that our hypotheses can account for most available data and present some new results that support this. We end by discussing the implications (...) of our account for folk psychology. Mon objectif dans cet article est de mieux cerner les contours d’une conception institutionnelle de la corruption. Je tenterai de contribuer à ce programme de recherches sur la corruption institutionnelle d’une double façon. Premièrement, j’essaierai de clarifier le concept de « corruption institutionnelle » en mettant en lumière quatre de ses principales caractéristiques et certains de ses avantages. Deuxièmement, je tenterai d’exposer trois problèmes auxquels sont confrontés ses partisans : les problèmes de la portée, du faux-diagnostic et de l’essentialisme. Malgré (...) la sympathie que j’ai pour cette approche, j’espère montrer qu’elle recèle certains points problématiques. Je tenterai essentiellement de montrer que les « institutionnalistes » risquent de faire de la corruption un concept normativement surchargé. (shrink)

Kant argued that Euclidean geometry is synthesized on the basis of an a priori intuition of space. This proposal inspired much behavioral research probing whether spatial navigation in humans and animals conforms to the predictions of Euclidean geometry. However, Euclidean geometry also includes concepts that transcend the perceptible, such as objects that are infinitely small or infinitely large, or statements of necessity and impossibility. We tested the hypothesis that certain aspects of nonperceptible Euclidian geometry map onto intuitions of space that (...) are present in all humans, even in the absence of formal mathematical education. Our tests probed intuitions of points, lines, and surfaces in participants from an indigene group in the Amazon, the Mundurucu, as well as adults and age-matched children controls from the United States and France and younger US children without education in geometry. The responses of Mundurucu adults and children converged with that of mathematically educated adults and children and revealed an intuitive understanding of essential properties of Euclidean geometry. For instance, on a surface described to them as perfectly planar, the Mundurucu's estimations of the internal angles of triangles added up to ∼180 degrees, and when asked explicitly, they stated that there exists one single parallel line to any given line through a given point. These intuitions were also partially in place in the group of younger US participants. We conclude that, during childhood, humans develop geometrical intuitions that spontaneously accord with the principles of Euclidean geometry, even in the absence of training in mathematics. Organismal death is foundational to the evolution of life, and many biological concepts such as natural selection and life history strategy are so fashioned only because individuals are mortal. Organisms, irrespective of their organization, are composed of basic functional units—cells—and it is our understanding of cell death that lies at the heart of most general explanatory frameworks for organismal mortality. Cell death can be exogenous, arising from transmissible diseases, predation, or other misfortunes, but there are also endogenous forms of death (...) that are sometimes the result of adaptive evolution. These endogenous forms of death—often labeled programmed cell death, PCD—originated in the earliest cells and are maintained across the tree of life. Here, we consider two problematic issues related to PCD (and cell mortality generally). First, we trace the original discoveries of cell death from the nineteenth century and place current conceptions of PCD in their historical context. Revisions of our understanding of PCD demand a reassessment of its origin. Our second aim is thus to structure the proposed origin explanations of PCD into coherent arguments. In our analysis we argue for the evolutionary concept of PCD and the viral defense-immunity hypothesis for the origin of PCD. We suggest that this framework offers a plausible account of PCD early in the history of life, and also provides an epistemic basis for the future development of a general evolutionary account of mortality. We describe an ontology of philosophy that is designed to aid navigation through philosophical literature, including literature in the form of encyclopedia articles and textbooks and in both printed and digital forms. The ontology is designed also to serve integration and structuring of data pertaining to the philosophical literature, and in the long term also to support reasoning about the provenance and contents of such literature, by providing a representation of the philosophical domain that is oriented around what philosophical literature (...) is about. We aim to provide the ontological grounds for an adequate account of persistence. We defend a perspectivalist, or moderate pluralist, position, according to which some aspects of reality can be accounted for in ontological terms only via partial and mutually complementary ontologies, each one of which captures some relevant aspect of reality. Our thesis here is that this is precisely the sort of ontological account that is needed for the understanding of persistence, specifically an account involving two independent ontologies, one (...) for continuants, and one for occurrents. Why would a philosopher choose to convey his ideas in the form of Manga? This discussion between Masahiro Morioka, author of Manga Introduction to Philosophy, and the translator of its French edition, Pierre Bonneels, shows how philosopher and artist Morioka became acquainted, through images, with fundamental abstract notions. After a short historical analysis of the aesthetic advantages of Manga, consideration is given to this unique way of provoking thought. On this basis, theoretical aspects of “time” and the “I” proposed (...) by Ōmori Shōzō are compared with Morioka’s Manga presentation. Although the questions raised are universal, the authors note that the use of Japanese metaphors enables these two thinkers to draw on a concrete understanding of notions like temporality and identity. Ce texte présente une partie de la pensée trouvée au sein de l’oeuvre de jeunesse du philosophe japonais Ōmori Shōzō qui appartient à l’école de Tokyo. L’objet de l’analyse proposée est celui de la logique. Le défi est de décrire que la nécessité des énoncés logiques exacts repose sur l’expérience. Ainsi cet examen découvre et expose le logicisme hyper empirique auquel Ōmori nous invite. Nous parlerons du sens possible de la logique « non scientifique » pour insister ensuite sur le (...) sens scientifique de cette dernière. Finalement, nous discuterons de la provenance de la nécessité que comportent en elles les phrases logiques. Nous présenterons ainsi deux origines distinctes de la nécessité. (shrink)

In this paper, we evaluate the project of resurgence of metaphysics based on the pecularity of the quantum domain, a project that is supported by some contemporary philosophers. Beyond the general arguments against scientific realism that are still applicable here, we show that this project is faced with the three following issues that, we believe, make it unrealizable: (a) the problem raised by the realistic interpretation of the wave function, as a description of a ‘concrete physical fact’ of the independent (...) reality; (b) the lack of any experimental counterpart of the (non-local) hidden variables quantum theories, and, in some cases, their incompatibility with the quantum predictions; and (c) the fact that the key-properties of quantum phenomena, like their non-locality, essentially depend on the observables that are used for their description and cannot then be assigned to any ‘independent’ reality. Developing earlier studies of the system of numbers in Mundurucu, this paper argues that the Mundurucu numeral system is far more complex than usually assumed. The Mundurucu numeral system provides indirect but insightful arguments for a modular approach to numbers and numerals. It is argued that distinct components must be distinguished, such as a system of representation of numbers in the format of internal magnitudes, a system of representation for individuals and sets, and one-to-one correspondences between the numerosity expressed by (...) the number and its metrics. It is shown that while many-number systems involve a compositionality of units, sets and sets composed of units, few-number languages, such as Mundurucu, do not have access to sets composed of units in the usual way. The nonconfigurational character of the Mundurucu language, which is related to a property for which we coin the term 'low compositionality power', accounts for this and explains the curious fact that Mundurucus make use of marked one-to-one correspondence strategies in order to overcome the limitations of the core system at the perceptual/motor interface of the language faculty. We develop an analysis of a particular construction, parallel numbers, which has not been studied before, elucidating the whole system. This analysis, we argue, sheds new light on classical philosophical, psychological and linguistic debates about numbers and numerals and their relation to language, and more particularly, sheds light on few-number languages. Current approaches to formal representation in biomedicine are characterized by their focus on either the static or the dynamic aspects of biological reality. We here outline a theory that combines both perspectives and at the same time tackles the by no means trivial issue of their coherent integration. Our position is that a good ontology must be capable of accounting for reality both synchronically (as it exists at a time) and diachronically (as it unfolds through time), but that these are (...) two quite different tasks, whose simultaneous realization is by no means trivial. The paper is structured as follows. We begin by laying out the methodological and philosophical background of our approach. We then summarize the structure and elements of the Basic Formal Ontology on which it rests, in particular the SNAP ontology of objects and the SPAN ontology of processes. Finally, we apply the general framework to the specific domain of biomedicine. (shrink)

Cet article défend une définition de l’exploitation, restreinte aux relations de travail, en tentant d’une part d’expliciter une certaine compréhension de sens commun du concept (rémunération inéquitable en fonction du travail presté), et d’autre part d’échapper aux difficultés qui ont affecté la définition marxiste traditionnelle de l’exploitation comme extorsion de la plus-value (dans ses diverses variantes). Il explore ainsi le lien entre l’exploitation et l’obligation matérielle de travailler pour subvenir à ses besoins fondamentaux. Après avoir mis en garde contre les (...) politiques d’activation des chômeurs, il conclut que l’exploitation est un phénomène contre lequel on peut lutter à l’aide de mécanismes relativement simples, même dans les sociétés capitalistes. Il rappelle toutefois que cela ne suffit pas à réaliser la justice sociale, resituant l’exploitation parmi d’autres enjeux fondamentaux pour une philosophie politique égalitariste. (shrink)

Pierre-François Moreau, auteur de la préface de l’ouvrage, entame ici une discussion sur les problèmes et les ressources d’une telle histoire.

The aim of this master’s thesis is to analyse and highlight the interaction between science, politics and law. More precisely, our research question concerns the use of scientific arguments in social spheres (notably in politics and law) instead of legal or political arguments. In fact, we want to raise the way in which certain actors invoke scientific arguments to impose "objective" elements of fact in debate and, in this way, refrain from politically and "subjectively" discussing these same elements (or, at (...) least, their social consequences). This Master’s thesis will adopt an interdisciplinary theoretical framework (chapter 1) mobilising philosophy of science, philosophy of law, sociology of law, legal technique and analytical theories. Then, we will apply it to a case study: the European regulation of genetically modified organisms (GMOs) after the European Court of Justice (CJEU) ruling of 25 July 2015 (chapter 2). The first chapter will provide theoretical elements to rethink the interaction between science, politics and law. The first section will propose a 'state of the art’ of the philosophical literature on the relationship between science (as a regime of truth) and politics. This master’s thesis will assess a truth under construction rather than a transcendental truth. Section 2 anticipates authoritarian claims based on science by considering the relationship science can have with power (Foucault). A solid review of philosophical, sociological and legal literature highlights the risks of giving decision-making power to an all-powerful science. Notably, the use of science to justify discriminatory policies is emphasised as these policies could not be challenged because, at the time, it was considered an objective scientific truth. Finally, section 3 offers a critique of the narratives of neutral and objective science, through the approach of science in action. This sociological approach presented all the doubts and subjectivity of science in action. The second chapter will propose a case study to illustrate the theoretical framework. We have chosen GMOs because they constitute a hybrid 'event', marked by scientific controversies, and with major socio-economic implications. The legal framework of GMOs in the European Union will be presented in the first section. In addition, the legal status of new breeding techniques (NBTs) will be examined. The second section will analyse the ruling of the European Court of Justice which made NBTs subject to GMO regulation. Finally, the third section will propose a reflection on the philosophy of law on the modes of existence of scientific, legal and political disciplines. (shrink)

In the intersection between eugenics past and present, disability has never been far beneath the surface. Perceived and ascribed disabilities of body and mind were one of the core sets of eugenics traits that provided the basis for institutionalized and sterilization on eugenic grounds for the first 75 years of the 20th-century. Since that time, the eugenic preoccupation with the character of future generations has seeped into what have become everyday practices in the realm of reproductive choice. As Marsha Saxton (...) (2000) and Adrienne Asch (2000, 2003) have forcefully argued, the use of prenatal screening technologies to facilitate the selective abortion of fetuses with features that signify disabling traits—the paradigm here being trisomy 21 in a fetus indicating Down Syndrome in the child—express a negative view of such disabilities sufficient to warrant terminating an otherwise wanted pregnancy. The eliminative structure of what Rosemary Garland Thompson (2012) has called eugenic logic persists in contemporary practices governing reproductive choice, social inclusion, and democratic participation and their relationship to disability. The tie between eugenics and contemporary disability studies suggests that eugenics and reflection on its history can also play a more positive role in disability politics. After focusing on eugenics in the first half of the paper, we will shift in the second half of the paper to eugenic resonances in contemporary thought and practice, concluding with some thoughts about ongoing practices of silencing and the very idea of eradicating disability.
